Please read these Terms and Conditions carefully before creating an account or using the Rooting Locals platform. By registering, browsing, or using any feature of this website, you agree to be bound by these terms in full. If you do not agree, please do not use this platform.

01 Parties & Agreement

This Agreement is entered into between Roots Marketing LLC ("Company," "we," "us," or "our") and you, the individual creating an account or using the Rooting Locals platform ("User," "you," or "your"). By accessing or using Rooting Locals, you represent that you are at least 18 years of age and have the legal capacity to enter into this Agreement.

02 Platform Description

Rooting Locals is a local business directory and community platform serving the Myrtle Beach, SC area. The platform allows users to discover local businesses, save favorites, leave reviews, view events, and receive notifications about local activity. Features are subject to change at our discretion without prior notice.

03 Account Registration & Security

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and update your information to keep it accurate
Keep your account credentials confidential and secure
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activity occurring under your account

We reserve the right to suspend or terminate accounts that contain false information, violate these terms, or engage in harmful conduct.

04 Data Collection & Privacy

By creating an account and using Rooting Locals, you acknowledge and consent to the following data practices:

Account Data: We collect your name, email address, and authentication credentials to manage your account.
Usage Data: We collect information about your interactions with the platform including businesses you view, save, or review.
Favorites & Preferences: Your saved businesses and preferences are stored to personalize your experience.
Communications: If you opt in, we may send email notifications about events, businesses you follow, or platform updates.

All data is stored securely using industry-standard encryption and access controls. We do not sell your personal information to third parties. Data is shared only as necessary to operate the platform (e.g., authentication providers, email services) or as required by law.

05 User-Submitted Content

You may submit reviews, ratings, and other content through the platform. By submitting content, you:

Represent that the content is accurate and based on genuine experience
Grant Roots Marketing LLC a non-exclusive, royalty-free license to display, reproduce, and distribute your content on the platform
Agree not to submit defamatory, false, harassing, or illegal content
Accept that we may remove content at our discretion without notice

You retain ownership of content you submit. We are not responsible for the accuracy of user-submitted reviews and do not endorse any user opinions.

06 Acceptable Use

You agree not to use the Rooting Locals platform to:

Submit false, misleading, or fraudulent reviews or information
Harass, threaten, or harm other users or business owners
Attempt to gain unauthorized access to any part of the platform
Scrape, copy, or reproduce platform content without written permission
Use the platform for any unlawful purpose
Impersonate any person or entity

Violation of acceptable use standards may result in immediate account termination.

07 Email Communications & Opt-Out

By creating an account, you may receive transactional emails related to your account activity (e.g., event notifications for businesses you follow). You may opt out of non-essential communications at any time by contacting us at rootsmarketing.llc2026@gmail.com. Transactional emails necessary for account security cannot be disabled.

08 Third-Party Services

The platform integrates with third-party services including but not limited to Google Maps, Firebase (Google), Brevo (email), and Airtable. Your use of these integrated services is also subject to their respective terms and privacy policies. Roots Marketing LLC is not responsible for the practices of third-party service providers.

09 Disclaimer of Warranties

The Rooting Locals platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses. Business information displayed on the platform is provided by business owners and we make no representations about its accuracy or completeness.

10 Limitation of Liability

To the fullest extent permitted by applicable law, Roots Marketing LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the platform, including but not limited to:

Loss of data, revenue, or profits
Reliance on business information displayed on the platform
Unauthorized access to your account or personal data
Actions or omissions of third-party businesses listed on the platform

Our total liability to you for any claim shall not exceed $100 USD.

11 Indemnification

You agree to indemnify, defend, and hold harmless Roots Marketing LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your submitted content, or your violation of these Terms.

12 Data Security & Breach Notification

We implement commercially reasonable technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. In the event of a data breach that affects your personal information, we will notify you in accordance with applicable law. However, no method of transmission over the internet is 100% secure and we cannot guarantee absolute security.

You submit data to this platform at your own risk. We are not liable for any breach caused by factors outside our reasonable control.

13 Account Termination

You may delete your account at any time by contacting us at rootsmarketing.llc2026@gmail.com. Upon termination, your personal data will be removed from active systems within a reasonable period, except where retention is required by law. We reserve the right to terminate accounts that violate these Terms without prior notice.

14 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the platform after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

15 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Horry County, South Carolina.

16 Entire Agreement

These Terms constitute the entire agreement between you and Roots Marketing LLC regarding your use of the Rooting Locals platform and supersede all prior agreements and understandings. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
